Terms of Service

1. Acceptance of Terms

By accessing or using Mailgent's services, including the API, console, and documentation at mailgent.dev (“Services”), you agree to be bound by these Terms of Service. If you do not agree, do not use the Services.

2. Description of Services

Mailgent provides identity infrastructure for AI agents, including email (Inbox), encrypted credential storage (Vault), TOTP code generation, and related APIs. The Services allow you to create agent identities, send and receive emails, store credentials, and generate authentication codes programmatically.

3. Account Responsibilities

You are responsible for:

  • Maintaining the security of your API keys and account credentials
  • All activity that occurs under your account and agent identities
  • Ensuring your use complies with applicable laws and regulations
  • The actions of any AI agents operating under identities you create

4. Acceptable Use

You agree not to use the Services to:

  • Send spam, unsolicited bulk email, or phishing messages
  • Impersonate individuals or organizations
  • Distribute malware or engage in activities that harm other users
  • Violate any applicable law, regulation, or third-party rights
  • Circumvent rate limits, authentication controls, or security measures
  • Store illegal content in the Vault

We reserve the right to suspend or terminate accounts that violate these terms.

5. Email Usage

Agent email addresses are provided on the @mailgent.dev domain. You must comply with CAN-SPAM, GDPR, and other applicable email regulations. We monitor sending patterns and may throttle or suspend accounts exhibiting abusive sending behavior. Email addresses and associated data are deleted when the identity is removed.

6. Vault and Credentials

Vault credentials are encrypted with AES-256-GCM and scoped per identity. You are responsible for the credentials you store. Mailgent does not have access to decrypted vault contents. We are not liable for losses resulting from compromised API keys or credentials stored in the Vault.

7. API Usage and Rate Limits

API usage is subject to rate limits based on your plan. We may adjust rate limits to ensure platform stability. Excessive or abusive API usage may result in temporary throttling or account suspension.

8. Intellectual Property

The Mailgent platform, APIs, documentation, and branding are owned by Mailgent. You retain ownership of content you create and data you store using the Services. You grant us a limited license to process your data solely to provide the Services.

9. Limitation of Liability

To the maximum extent permitted by law, Mailgent shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities. Our total liability is limited to the fees you paid in the 12 months preceding the claim.

10. Service Availability

We strive for high availability but do not guarantee uninterrupted access. We may perform maintenance that temporarily affects service availability. We will provide reasonable notice for planned maintenance when possible.

11. Termination

You may terminate your account at any time through the console. We may terminate or suspend your account for violations of these terms. Upon termination, your agent identities, email data, and vault credentials will be deleted within 30 days.

12. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated via email or console notification at least 30 days before they take effect. Continued use of the Services after changes constitutes acceptance.
